Charging Order - Property 

Gary Lidington represented the Claimant in a claim for an order for sale of a property pursuant to a Charging Order. The claim was originally fully resisted on numerous grounds of law and fact. However, following exchange of skeleton arguments on the morning of the trial, the Defendants conceded that the Claimant was entitled to an order for sale and the trial proceeded on the issue of the length of the period of postponement of the order alone. The Court awarded the Claimant its costs on an indemnity basis.
