British Coal Miners' Compensation Scheme
Alan Gourgey QC has been heavily involved in litigation and other proceedings connected with the British Coal Miners' compensation scheme. These include acting for the UDM in a successful claim against DBERR relating to payments made under the scheme and also acted for the UDM in an application before Swift J for the fixing of cost tariffs under the Scheme (see [2007] EWHC 672). He is also acting for solicitors involved with the scheme in their successful defence of an application made against them for a group litigation order (see the Judgment of Sir Michael Turner at [2006] EWHC 1134). Most recently he acted for former partners of Beresfords in their unsuccessful defence of disciplinary charges before the SDT.
