Corporate Manslaughter Act - Solving the Identity Crisis?

David Stern has written a bulletin to accompany his seminar from late 2008 on the Corporate Manslaughter Act. Michael Beckman QC has written the foreword.

Legislation aimed at creating corporate liability in a criminal context is on the increase.  Whereas previously, solicitors may not have needed to advise their corporate clients other than in a commercial context, as a result of new statutory developments, advice, guidance and representation may now be more likely required in situations of alleged corporate criminality.

This bulletin considers the new Corporate Manslaughter Act.  Instead of requiring a single individual with sufficient responsibility to make a corporation liable, the Act attempts to impose such liability more broadly to the role of senior management.

Will the new regime work? What other difficulties does the legislation create? How can a company prepare itself for such an event and what can its lawyers do in the event of a prosecution to protect its interests?
