Some notable cases - West Bromwich Building Society v Wilkinson (Court of Appeal [2004] EWCA Civ 1063, andHouse of Lords [2005] 4 All ER 97), which concerned limitation of actions for mortgage arrears shortfalls and is one of the few real property cases that have reached the House of Lords, Benn v Hardinge 66 P & CR 246, which concerned abandonment of easements and caused a re-write of a passage in Megarry and Wade’s Law of Real Property; Sampson v Floyd (1989) 2 EGLR 49 which concerned damages for breach of the covenant for quiet enjoyment.
